Team Duterte is trying to punch a hole in the ICCโ€™s latest move. After the court confirmed crimes-against-humanity charges tied to the drug war, his lawyers filed a request asking the ICC to allow an appealโ€”basically saying the ruling is legally shaky and too vague for anyone to properly defend against.

The core complaint: the defense says the ICC decision reads like a โ€œflexibleโ€ case that can keep stretchingโ€”dates, places, victims, even the exact incidentsโ€”without being pinned down cleanly. Their argument is simple: if the accusations arenโ€™t clearly locked in, the trial becomes a moving target, and thatโ€™s not how โ€œfair processโ€ is supposed to work.

They also hit the ruling for allegedly not laying out the evidence clearly behind its conclusions. In their view, the court confirmed major charges but didnโ€™t show enough of the receipts in the decision itselfโ€”so the defense is asking: How do you fight whatโ€™s being claimed if the foundation isnโ€™t properly spelled out?

One important detail: this isnโ€™t an automatic appeal. Under ICC rules, the defense needs the judgesโ€™ permission firstโ€”meaning the same panel that confirmed the charges has to decide whether an appeal even gets opened. So this is step one: โ€œLet us challenge this ruling before the case moves deeper.โ€
